To bring amicable resolution of potential aquaculture fishery claims following the Penglai 19-3 spill events, ConocoPhillips and CNOOC entered into a settlement agreement with the Ministry of Agriculture (“MOA”), which provided one Billion RMB (approximately $160 million) in compensation funds to the MOA for aquaculture claimants deemed eligible by the MOA, as well as for damages to natural fishery resources in Bohai Sea.  The claimants who brought suit in this proceeding were eligible to receive MOA compensation, but elected to bring claims significantly higher than the MOA’s damage assessment.  ConocoPhillips believes that the Court’s verdict for damages is consistent with the purpose of the settlement agreement.
In addition, in 2012, ConocoPhillips amicably entered into a settlement agreement with the State Oceanic Administration (“SOA”) to provide 1.09 Billion RMB (approximately $175 million) to be used to restore the marine ecological environment of the Bohai Sea.
Further, ConocoPhillips has paid RMB 100 million (approximately $16 million) to the MOA to administer environmental programs targeted at helping improve fishery resources, as well as 113 million RMB (approximately $18 million) to support initiatives that will enhance marine ecological protection and reduce pollution in Bohai Sea, to be implemented by the SOA.
